SAAIA Files POPIA Complaint Against LinkedIn for AI Model Training Practices

The South African Artificial Intelligence Association (SAAIA) has lodged a formal complaint with the Information Regulator of South Africa, raising concerns about LinkedIn's use of personal data for AI model training. SAAIA claims LinkedIn's practices may breach key legal conditions under the Protection of Personal Information Act (POPIA). The complaint seeks to address the potential misuse of South African users' data and calls for greater accountability in AI development.

Johannesburg, South Africa – 15 October 2024 – The South African Artificial Intelligence Association (SAAIA) has formally complained to South Africa’s Information Regulator regarding LinkedIn’s use of personal data from South African users to train its artificial intelligence (AI) models. The association argues that LinkedIn has failed to meet the necessary legal requirements under the Protection of Personal Information Act (POPIA).


In the complaint, SAAIA highlights three critical areas of concern:

     

      1. LinkedIn’s use of data allegedly does not comply with lawful processing conditions as Chapter 3 of POPIA requires.

      2. Their actions may amount to interference with personal information, as outlined in Section 73 of POPIA.

      3. Due to the significant public interest, SAAIA believes the matter warrants a thorough investigation by the Information Regulator.

    Dr Nick Bradshaw, founder of SAAIA, commented on the urgency of the issue, noting, “The rapid pace of AI development is transforming industries globally, but we must ensure that local communities are not negatively impacted, particularly when it comes to how our personal data is being utilised.”


    Nathan-Ross Adams, who heads up regulatory affairs for SAAIA and played a key role in drafting the submission, emphasised that this issue goes beyond legal technicalities. “We are witnessing a new era where data has become a form of currency, and it’s crucial that individuals’ rights are safeguarded as AI technologies evolve. Accountability must be at the forefront of AI development,” Adams said.


    SAAIA is dedicated to fostering responsible AI practices across South Africa and ensuring that all sectors of society, not just a select few, feel the benefits of AI. The association’s mission is to involve citizens, governments, and AI professionals in these important discussions to build a future where AI development aligns with fairness, inclusivity, and transparency principles.

    As the conversation around AI and privacy continues, SAAIA will be spotlighting these issues at AI Expo Africa 2024, the largest gathering of AI practitioners on the continent. The event will take place from 30-31 October at the Sandton Convention Centre, Johannesburg, and will bring together experts and innovators to discuss privacy, regulation, and the future of responsible AI.
